The Warsaw City Council met in regular session on Monday,  March 9, 2009 at the city building 303 East Main Street at 7:30pm.  

 

Council members present:   Keith Jones,  Randy Jones, Charlie French,  Jackie Giles, Brandon Terrell and Jamie Gould.    Keith Jones acted as the Vice-Mayor due to Mayor Simpson on vacation.

 

Attorney Mike Duncan was present.

 

Visitors present:    Clay Warnick, Winslow Baker, Rick and Joseph Ackermann, Josh Morley, Linda Bailey, Rhonda Wells, Arthur Hawkins, Steve Henderson    

 

Mayor Simpson called the meeting to order and welcomed all present.  

 

#1 Approval of the Agenda

Additions:  Jamie Gould added water leak, Randy Jones added speed limit west of Warsaw and sidewalks along Ferry Boat hill, Brandon Terrell added AED.  

A motion by Randy Jones  seconded by Jackie Giles to approve the agenda with the additions.  Motion carried unanimously.

 

#2 Approval of the Minutes from previous meeting

A motion by Jackie Giles seconded by Brandon Terrell approving the minutes from the previous meeting.  Motion carried unanimously.

 

#3  Approval of financial statements & bills for the month

 A motion by Randy Jones seconded by Charlie French approving the financial statements and bills for the month.  Motion carried unanimously.

 

#4  Recognition of Audience

No one present.

 

#5  WATER IMPROVEMENT PROJECT

a.         City Clerk Carolyn Marksberry apologized for the lateness with the March water bills.  The next phase of the water meter system change out did  not go as expected and there were several computer issues. 

b.      A motion by Jackie Giles seconded by Jamie Gould to approve Resolution 2009-09 authorizing payments be made regarding the Warsaw Water System Improvement Project.  Voice vote:  Brandon Terrell yes, Charlie French yes, Keith Jones yes, Randy Jones yes, Jamie Gould yes, and Jackie Giles yes.  Motion carried unanimously.

 

#6  RENAISSANCE ON MAIN

Steve Henderson, Renaissance manager updated Council on several items:

·        Spring banners will be put up soon by city workers

·        Flower baskets will be hung this year with geraniums

·        The docents will again be at the Welcome Center on Fridays and Saturdays.

·        The Gallatin County School system will be notified that the Welcome Center is available for use or tours. This is an attempt to get the building more exposure.

·        Brenda Hawkins with the Renaissance group suggested a garden club be started.

·        More memorial bricks have been installed at the park.

·        A new updated Walking Tour brochure has been created along with a video that will be added to the city’s website.  They would also like to play the video at the welcome center for guests.

·        The Craigs Creek Boat ramp project is progressing.  Gary Thompson, Clifford Higgins, Rick Cayton, Mike Sullivan have all donated their time on the project.

·        Gazebo Project – bids had been opened at the February council meeting but a decision on awarding the project delayed until the March meeting.  Steve advised that he had applied for a grant with Land and Water but would not know until May if it had been awarded.  He would like approval to use the city’s CDBG money market if the grant funds do not get approved or for the 50% required by the grant.

A motion by Jackie Giles seconded by Brandon Terrell to use CDBG funds for the gazebo project either 50% of the necessary funds required by the grant or if necessary the entire cost if the grant does not get approved. Voice vote:  Charlie French yes, Keith Jones yes, Randy Jones yes, Jamie Gould yes, Brandon Terrell yes, Jackie Giles yes.  Motion carried unanimously.

 

Steve’s recommendation was that the Gazebo project be given to low bidder Ken McFarland of McFarland Construction.

A motion by Jackie Giles seconded by Jamie Gould to accept the bid by McFarland Construction for $11,239.74 for the construction of a 28’ gazebo at the city park.  Voice vote:  Brandon Terrell yes, Charlie French no, Keith Jones yes, Randy Jones yes, Jamie Gould yes, Jackie Giles yes.  5 yes votes and 1 no vote motion carried. 

 

·        Steve also inquired as to the status of the burned out property on the corner of Fourth Street and Main Street.  Vice Mayor Keith Jones advised that would be discussed under the Code Enforcement section for Winslow Baker.

 

#7  WINSLOW BAKER

·        Mr. Baker advised that the house on the corner of Fourth Street and Main Street that had burned was in the process of being purchased by the Gallatin County Library.  The process would take about 30 days to finalize but once done immediate cleanup would take place.

·        The Code Enforcement group has had several meetings etc to discuss several letters sent out regarding violations and issues.

·        Several grants had been applied for.

·        Serious questions were raised regarding a trailer on Riverview Drive inside the old “Frenchs Trailer park”.    It was Mr. Baker’s opinion that the trailer could stay where it is presently located per the city’s  zoning ordinance.  Attorney Mike Duncan advised that per ordinance you could not add to the number of originally approved mobile homes in the non-conforming park and that replacement of a home there did not necessarily have to be in the same location however,  fire code and health department regulations must be followed and adhered to.

The new owner of the park, Linda Bailey was present and advised she was working on plans for a new parking lot and that it was not her intent to cause any trouble with this home.  Several council members expressed concerns regarding where the property lines were located as well as the sewer and water lines. 

After much discussion it was agreed that the City needs to get documentation from the Fire Marshall/Fire Chief, Ashley Froman, and Eric Moore regarding this issue. 

 

                                                                                                         

 

#8   RECYCLING

Vice Mayor Keith Jones advised that this matter had been tabled from last month.  He advised that a boy scout would be looking into this project and report back.

 

#9  UPDATE ON WATER DAMAGE AT CITY HALL

City Clerk Carolyn Marksberry reported that Farm Bureau Insurance has paid the claim the city made regarding recent water infiltration into the office from recent snow/ice storms.  It was the opinion of an engineer hired by Farm Bureau that an ice dam had caused the issue which may or may not ever happen again. 

 

Additions:

 

Josh Morley;  a scout working on his Eagle Scout badge advised he had a quote for dug out for the City’s sports park.  The quote from Carrollton Fence  was for 6 dug outs for $26,143.50 this does not include concrete.  Council agreed to table this matter.

 

Councilman Jamie Gould; advised that his wife’s grandmother had had a major leak at her trailer in Raymond’s trailer court.  He inquired as to the guidelines on receiving adjustments.  A plumber had found a broken pipe under the trailer that may or may not have been vandalism.  City Clerk Carolyn Marksberry advised with proper documentation from the plumber a sewer adjustment could be made.  She advised that a leak had existed for the past several months.  Council gave approval for the clerk to review the history of the account and give an adjustment.

 

Randy Jones; Councilman Jones inquired as to the status of the speed limit on US 42 West.  He would like to see the speed limit changed/lowered to reflect the same speed both entering and leaving Warsaw at the same spot.  It was agreed that the Mayor would contact the State regarding a petition to change. 

 

Randy Jones; Councilman Jones inquired as to rebuilding sidewalks along Ferry Boat hill where a recent fire had destroyed a building located here.  Councilman Brandon Terrell advised he thought there might be a fire hydrant on the hill with a valve issue/damage that should be looked at prior to sidewalks being installed. 

 

Brandon Terrell; Councilman Terrell inquired whether or not the Warsaw Police Dpt needs another AED.  They have one but typically there are 2 officers on at a time.  Council agreed to ask the Chief of Police. 

 

With no more business on the agenda, a motion by Randy Jones seconded by Brandon Terrell to  ADJOURN.    Meeting adjourned at  8:36 pm
